As many of you know, we work closely with US Customs and Border Protection (CBP) to communicate issues and work on regulations that affect General Aviation. We have been emphasizing to CBP the importance of finding ways that eAPIS can eliminate other tasks and burdens faced by General Aviation pilots so that there is a "win-win" as a result of the eAPIS implementation.

We are happy to alert you that we have been notified by CBP of changes to the rules regarding over-flight exemptions that have a positive impact on General Aviation flights. The changes to the rule allow operators with a valid over-flight exemption to fly to any airport where CBP is present even if that airport is not on the over-flight exemption. In addition, operators are NO LONGER required to have at least one of the passengers listed on the over-flight exemption on board the aircraft in order to utilize the over-flight exemption. The change also allows the aircraft to use the exemption even if there are NO passengers on board the aircraft.
